This Privacy Policy explains how Snows Down Low collects, uses, discloses, and retains personal information when you visit snowsdownlow.com (the “Site”), use the Snows Down Low mobile application (the “App”), make a purchase, contact us, or otherwise use our services (collectively, the “Services”).

This policy applies only to the Services. Third-party websites, applications, and services have their own privacy practices.

The App is initially offered in the United States and Canada.

Information We Collect

Depending on how you use the Services, we collect the following categories of information:

Account and profile information. If you create or use an account, our WordPress-based account system collects your email address, password, username or display name, and account identifiers. You may also provide a first name, last name, and phone number. Passwords are stored in hashed form rather than readable plain text.

Order and transaction information. When you place a website order, we collect information needed to process and fulfill it, such as your name, email address, billing and shipping address, phone number, products ordered, order amount, transaction status, and order history. Payment information is handled by our payment providers as described below.

Marketing information. If you opt in to email or SMS marketing, we record your choice and provide your email address and, for SMS, phone number to Klaviyo. We may also provide your name and information about your interactions with our Site or messages where enabled through our website and marketing configuration. You can withdraw your consent as described under “Your Choices.”

Guest and app identifiers. If you use the App without creating an account, we assign an app-user identifier to maintain your guest session and associate purchases and entitlements with it. If you later create or sign in to an account and verify your email address, you may link eligible guest purchases to that account.

App purchases and entitlements. Apple or Google processes purchases made through the App. We use RevenueCat to verify purchase status and manage access to purchased content and features. We and RevenueCat process information such as an app-user identifier, product and transaction identifiers, purchase history and status, storefront information, and related technical information. We do not receive your full payment-card number for an App Store or Google Play purchase.

Saved content and preferences. If you use these features, we collect favorites, playlists, saved mixes, marketing preferences, and the settings and track identifiers needed to provide and synchronize them.

Communications and support information. We collect information you submit through our contact forms, email, telephone calls, reviews, surveys, or customer-support communications, including the content of your message and any order or contact information you provide.

Device, log, and diagnostic information. When you use the Services, we and our service providers may automatically receive information such as IP address, browser type, operating system, app version, device or app identifiers, request timestamps, referring pages, pages or features used, crash data, performance data, and security or fraud signals. Sentry crash reporting for the App and backend is enabled only when we configure it. The App also uses Expo Application Services to check for and deliver software updates; update requests include operating-system and app/project information and a randomized installation token.

On-device data. The App stores its authentication token in the operating system’s secure credential storage. It also stores a local cache of profile information, catalog and entitlement data, favorites, playlists, saved mixes, and pending changes so supported features can work offline. This cached information remains on the device until it is cleared through the App, the App is uninstalled or its data is cleared, or the operating system removes it. Some secure credential storage may persist according to the device operating system’s behavior.

Local audio playback. Supported audio is bundled with the App and plays locally. We do not stream that audio from our servers or intentionally record individual listening or playback events on our servers.

Cookies and Similar Technologies

The Site and the third-party services used on it may use cookies, pixels, local storage, and similar technologies to keep the Site functioning, maintain sessions and shopping carts, remember preferences, understand Site and message usage, measure marketing performance, and help prevent fraud. These technologies may be associated with information you previously provided or with identifiers assigned to your browser or device. Your browser may allow you to block or delete cookies, but doing so may prevent some Site features from working.

The App does not use browser cookies for its native features. It does use local device storage and app identifiers as described above. If you open the Site or another website from the App, that website’s cookie practices apply.

How We Use Information

We use personal information to:

  • provide, maintain, personalize, and improve the Services;
  • create and manage accounts and guest sessions;
  • process, fulfill, and support orders and purchases;
  • verify ownership, restore purchases, and provide access to content and features;
  • synchronize saved content and preferences;
  • send transactional messages and, with the required permission, marketing messages;
  • respond to questions, support requests, and rights requests;
  • monitor reliability, diagnose errors, secure the Services, prevent fraud and abuse, and enforce our terms; and
  • comply with law and protect our rights and the rights of others.

How We Disclose Information

We do not sell personal information. We may disclose information to:

  • Website, commerce, and hosting providers, including our WordPress host, WordPress, WooCommerce, and Stripe, which host the Site and process accounts, orders, fraud checks, and website payments.
  • Marketing and communications providers, including Klaviyo, when you subscribe to marketing or interact with marketing features on the Site.
  • App-platform and purchase providers, including Apple, Google, and RevenueCat, which distribute the App and process, verify, and manage App purchases and entitlements.
  • App delivery and diagnostics providers, including Expo and, when configured, Sentry, which deliver App updates and help us diagnose errors and performance problems.
  • Professional advisers and operational providers that help us run the business, subject to appropriate confidentiality obligations.
  • Government authorities or other parties when disclosure is required by law or reasonably necessary to respond to legal process, prevent or investigate fraud or security incidents, enforce agreements, or protect rights, property, safety, and the Services.
  • A successor or transaction participant in connection with a merger, financing, acquisition, reorganization, bankruptcy, or sale of all or part of the business, subject to applicable law.

Some providers, such as Apple, Google, and Stripe, may also process information under their own privacy policies.

Where a provider processes personal information on our behalf, we require it to protect that information consistent with its contractual obligations and applicable law.

Data Retention

We retain information only for as long as reasonably necessary for the purposes described in this policy:

  • Account, profile, entitlement, and saved-content information is generally retained while the account remains active and as needed to provide purchase restoration and support.
  • Order, transaction, entitlement-source, tax, and accounting records may be retained after account deletion when reasonably necessary to complete transactions, preserve purchase and refund history, prevent fraud, resolve disputes, enforce agreements, and meet legal, tax, and accounting obligations.
  • Marketing profile information is retained while you remain subscribed or while we have another legitimate need for it. If you unsubscribe, we may retain limited suppression information so we can honor that choice.
  • Support communications, security logs, and diagnostic information are retained for a limited period appropriate to their purpose, unless a longer period is reasonably necessary for security, legal compliance, dispute resolution, or the protection of rights.
  • Information stored only on your device remains there as described under “On-device data.”

When information is no longer needed, we delete or de-identify it where reasonably practicable. Our service providers may maintain information under their own retention schedules or as legally required.

Your Choices

You may opt out of email or SMS marketing at any time by using the unsubscribe link in our emails, replying STOP to our texts, or updating your marketing preferences in the App’s account screen.

You may request access to, correction of, or deletion of your personal information by contacting us as described below. Depending on where you live, you may have additional rights, including the right to receive a portable copy of certain information or to appeal our response. We may need to verify your identity before completing a request. We may retain information that we are required or permitted to keep, including transaction and entitlement records needed for legal, accounting, fraud-prevention, refund, and purchase-restoration purposes.

Deleting a Snows Down Low account does not automatically cancel an App Store, Google Play, or website subscription or issue a refund. Those transactions must be managed through the provider through which they were purchased.

Children’s Privacy

The Services are intended for a general audience and are not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us with personal information, please contact us and we will take appropriate steps to delete it.

Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. For example, App authentication tokens are stored in the device’s secure credential storage and passwords are stored in hashed form. No security measure or method of transmission or storage is completely secure, so we cannot guarantee absolute security.

Processing in the United States

Snows Down Low and many of its service providers operate in the United States. If you use the Services from another country, your information may be transferred to, stored in, and processed in the United States or another country where privacy laws may differ from those where you live.
